The EPA is proposing revisions to Section 401 that would undermine California’s power to ensure local dam and hydropower projects permitted by the federal government do not hurt the Yuba and Bear River watersheds. Section 401 certification is the next step for both ongoing relicensing processes for hydropower projects in the Yuba and Bear River watersheds. This rule will threaten those processes by allowing agencies and companies to evade the Clean Water Act.
